Supreme Court lifts hold on Idaho same-sex marriages

idaho stay denial

The U.S. Supreme Court allowed same-sex marriages to move forward in Idaho Friday, denying a request by state officials to stay a federal appeals court’s ruling overturning the state’s same-sex marriage ban.

“The application for stay presented to Justice Kennedy and by him referred to the Court is denied,” the Friday order stated. The Supreme Court’s decision to allow same-sex marriages to proceed in Idaho comes after the 9th Circuit Court of Appeals ruled Tuesday that same-sex marriage bans in Idaho and Nevada are unconstitutional. Kennedy previously stayed that decision for both states, but lifted the stay for Nevada (according to a Supreme Court spokesperson, the stay in Nevada was issued by mistake). Same-sex marriages began in Nevada yesterday.
