Will it matter if the judge is gay? Proposition 8 court case judge’s personal life comes into focus

”There is nothing about Walker as a judge to indicate that his sexual orientation, other than being an interesting factor, will in any way bias his view…. There wasn’t anyone who thought (overturning Prop. 8) was a cakewalk given his sexual orientation.”

Kate Kendall of the California-based National Center for Lesbian Rights discussing the mostly unspoken fact that the judge presiding over the much-watch challenge to Proposition 8, Judge Vaughn Walker, is a gay man. Gay marriage supporters do not see that as a any kind of guaratee, it is reported by the San Francisco Chronicle, because the judge tends to have libertarian decisions. Anthony Pugno, working as defense for the infamous anti-gay marriage bill, says Judge Walker’s sexual orientation will not be discussed but added that they did feel Walker was not being fair in his proceedings with the promoters of Prop8. State Senator Mark Leno points out that no one questioned the sexual orientation of the Supreme Court justices when they heard an earlier related challenge. (San Francisco Chronicle)
