Groups challenging Medicare ban on gender-reassignment surgeries

“Medicare’s categorical exclusion of this care lacks any scientific basis. Study after study has shown that these surgeries are the only effective treatment for many patients suffering from severe gender dysphoria.”

Shannon Minter, legal director of the National Center for Lesbian Rights (NCLR), as quoted in a release today announcing that his group, along with the American Civil Liberties Union (ACLU) and Gay & Lesbian Advocates & Defenders (GLAD), have filed an administrative challenge to Medicare’s ban on all gender-reassignment surgeries. The U.S. Department of Health and Human Services (HHS) announced prior that the ban is to be reviewed by its Department Appeals Board, which exists to provide independent and impartial review of HHS program disputes.
